State Law Overview

Generally speaking, in all 50 states, this is a solid general rule to begin your analysis of what your state laws says about force and deadly force and when each can be used. This is an introduction to the many state law variations of this theme. It is not an exhaustive research tool.

“You have the right to defend yourself with reasonable force, up to and including deadly force, if you are greeted by deadly force and such deadly force is imminent.”

Included on this website are the States Penal Codes that address your right to defend yourself. These laws are written differently. Some are easy to understand. Others seem calculated to be confusing. Each State Legislature has authority to make these laws. When they are different from Federal Laws, Federal Law wins. But you need to know what the laws of your state are if you own a firearm, carry a firearm, transport a firearm, or use a firearm in defense of self or other persons. This is true with any weapon you may have or use for self-defense or defense of others.

  • Some states define “deadly force” differently.
  • Some states allow deadly force to be used to protect certain types of property; but not all.
  • Some states allow open carry; but not all.
  • Some states allow concealed carry; but not all.
